Terms & Conditions
1. Introduction
These Terms and Conditions ("Terms") govern the photography services provided by Amplify Creative Lab ("we", "us", or "our") to you ("the Client"). By booking a shoot or paying a deposit, you agree to be bound by these Terms.
We are based in Perth, Western Australia.
2. Bookings and Payments
Booking Fee: To secure your date or session, a non-refundable booking fee (typically 50% of the total quote) is required. No booking is confirmed until this fee is paid.
Balance: The remaining balance is due prior to the delivery of the final high-resolution images.
Invoices: Invoices must be paid within 7 days of issue unless otherwise agreed in writing.
GST: All quoted prices include GST where applicable under Australian tax law.
3. Cancellations and Rescheduling
Client Cancellation: If you cancel within 48 hours of the scheduled shoot, the booking fee is forfeited to cover our loss of business.
Rescheduling: We understand that life happens. One reschedule is permitted without penalty if requested more than 48 hours in advance. Subsequent reschedules may incur a re-booking fee.
Weather: For outdoor shoots, we reserve the right to reschedule due to inclement weather (for example, heavy rain or storms) at no extra cost.
4. Copyright and Usage Rights
Ownership: Amplify Creative Lab retains the copyright to all images created.
Client Licence: Upon full payment, we grant you a non-exclusive, perpetual, worldwide licence to use the images for your business marketing (for example, website, social media, print ads, menus).
Third-Party Platforms: Your licence includes the right to upload images to third-party platforms used for your business operations (for example, Uber Eats, Menulog, Google Business Profile, online ordering systems).
Restrictions: You may not sell the images to third parties (for example, stock libraries) or sublicense them for separate commercial gain without our written permission.
AI and Derivative Works: You may not use the images to train artificial intelligence models or create AI-generated derivative works without our express written consent.
Our Use: We reserve the right to use the images for our own self-promotion (for example, portfolio, website, social media) unless a Non-Disclosure Agreement (NDA) has been signed.
5. Delivery and Archiving
Turnaround: Standard turnaround time is 7–14 business days from the shoot date, depending on the project scope.
Storage: We will archive your images for 12 months. After this period, we are not liable for the storage or retrieval of your files. We recommend you back up your images immediately upon receipt.
6. Limitation of Liability
In the unlikely event that we cannot perform the services due to illness, emergency, or equipment failure, our liability is limited to a full refund of all monies paid. We are not liable for any consequential damages or lost profits.
Consumer Guarantees: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
7. Complaints and Disputes
Internal Resolution: If you have a complaint about our services, please contact us first at hello@amplifycreativelab.com. We will endeavour to resolve any concerns fairly and promptly.
External Resolution: If we cannot resolve a dispute to your satisfaction, you may seek assistance from:
- The WA Department of Mines, Industry Regulation and Safety (Consumer Protection) for consumer disputes.
- The State Administrative Tribunal (SAT) for minor civil claims in Western Australia.
8. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
9. Jurisdiction
These Terms are governed by the laws of Western Australia. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
